SEDO IP Complaint Policy

As the provider of an international marketplace for the purchase and sale of domain names and websites, please note that Sedo is not in a position to arbitrate intellectual property (IP) disputes between domain name owners and trademark owners. As stated in our User Agreement, the domain name owners themselves are responsible for the domain names they list for sale or park with Sedo. Accordingly, we encourage IP rights owners to resolve their disputes directly with the domain owners, particularly because the domain owners may have similar listings on other sites.

As a courtesy to IP rights owners, however, we are willing to perform a limited investigation of reasonable complaints. Our procedure differs depending on the country in which trademark rights exist. Filing a complaint does not guarantee that Sedo will take action to remove the domain name from the Sedo domain database or block the domain from Sedo’s domain parking program. Due to the detail-specific nature of IP disputes, Sedo will not investigate complaints that do not substantially comply with the procedures below.

IP Complaint Procedure – IP rights in U.S. and Canada

When we receive a complaint from an IP rights owner, we will only investigate whether the domain name(s) listed for sale or being parked with Sedo are using terms corresponding to the protected term in the domain name itself.

If you are an IP rights owner (or represent a rights owner) and have an objection to a domain owner’s use of a term corresponding to your IP rights in a domain name they are listing for sale or parking with Sedo that is consistent with the foregoing, please provide the following information in a signed letter on company or firm stationery:

  1. Name of Company
  2. Contact information (including email address)
  3. List of intellectual property right(s) at issue and the country/countries in which it is registered
  4. The specific domain names at issue.
  5. If certain affiliates or partners are permitted to use your trademark in their domain names, please list the company names in your letter.
  6. Include the following statement: “I have a good faith belief that use of the trademarks described above with domain names described above are not authorized by the trademark owner or its agent, nor is such use otherwise permissible under law.”
  7. Include the statement: “I represent that the information in this notification is true and correct and that I am authorized to act on behalf of the trademark owner.”
  8. Your signature.

IP Complaint Procedure – IP rights outside U.S. and Canada

When we receive a complaint from a trademark owner, we will only investigate whether the domain name(s) listed for sale or being parked with Sedo are using terms corresponding to the trademarked term in the domain name itself or as keyword trigger for the advertising content of a parking page.

If you are a trademark owner (or represent a trademark owner) and have an objection to the use by a Sedo user of a domain name that includes a term corresponding to your trademark, please provide the following information in a signed letter on company stationery:

  1. Name of Company
  2. Contact information (including email address)
  3. List of trademark(s) at issue and the country/countries in which it is registered
  4. The specific domain names at issue. Please indicate if your complaint is limited to specific domain name or if it is a general objection to all domain names listed for sale or parked with Sedo containing a term corresponding to the trademarked term.
  5. Are you concerned with:
    1. The domain name itself
    2. Parking pages in relation to a domain name
    3. Both?
  6. If certain affiliates or partners are permitted to use your trademark in their domain names, please list the company names in your letter.
  7. Include the following statement: “I have a good faith belief that use of the trademarks described above with domain names described above are not authorized by the trademark owner or its agent, nor is such use otherwise permissible under law.”
  8. Include the statement: “I represent that the information in this notification is true and correct and that I am authorized to act on behalf of the trademark owner.”
